01 The Site Is Informational

The Site provides information about the community, available homes and lots, amenities, pricing, and policies, and lets you contact the office, apply for residency, and make payments. Information on the Site is provided for convenience and may contain errors or become outdated. Availability, rent amounts, specials, fees, and community rules are subject to change without notice and are confirmed only in a signed lease or written communication from the office.

Nothing on the Site is an offer to lease. A home or lot is not reserved, and no lease exists, until a written lease is signed by both you and Hometown Meadows.

02 Eligibility

You must be at least 18 years old to submit an application or make a payment through the Site. By using the Site, you represent that you meet this requirement and that all information you provide is true, accurate, and complete.

03 Rental Applications

• Accuracy — You are responsible for the accuracy of your application. False, incomplete, or misleading information is grounds for denial or, if discovered after move-in, termination of your lease.
• Application fee — A non-refundable application fee of $25 per adult applicant is charged when you submit an application. The fee covers screening costs and is not refundable regardless of the outcome, unless refund is required by law. An application is not considered submitted for screening until the fee has been paid.
• Screening authorization — By submitting an application, you authorize Hometown Meadows and its screening vendors to obtain consumer reports, including credit, criminal background, eviction history, and identity verification, and to contact your landlords, employers, and references.
• Decisions — Applications are evaluated under written screening criteria applied uniformly to every applicant. Meeting the criteria does not guarantee a home will be available. We will notify you of a decision, and if we take adverse action based on a consumer report we will provide the notice required by the Fair Credit Reporting Act.
• Holding a home — A home is held for you only after you are approved, sign a lease or holding agreement, and pay any required deposit.

04 Online Payments

• Processor — Payments made through the Site are processed by a third-party payment processor. Your use of the payment page is also subject to that processor's terms.
• Authorization — By submitting a payment, you authorize the charge to your payment method for the amount shown, and you represent that you are authorized to use that payment method.
• Timing — A payment is credited to your account when it is received and confirmed by the processor, not when it is initiated. You are responsible for submitting rent early enough to be received by the due date. Rent is due on the 1st of each month; a $75 late fee posts on the 6th.
• Returned payments — If a payment is returned or reversed for any reason, the amount is considered unpaid, late fees apply as provided in your lease, and a returned-payment fee may be charged.
• Refunds — Application fees are non-refundable. Deposits are handled as described in your lease and Arkansas law. Duplicate or erroneous payments will be refunded or credited to your account on request.
• Portal availability — If the online payment option is unavailable, you remain responsible for paying on time by another method accepted by the office.

05 Text Messages and Communications

By providing your phone number to Hometown Meadows, you consent to receive SMS/MMS text messages from us about your inquiry, application, or residency. These may include home and lot availability updates, tour scheduling and confirmations, application status, rent reminders, maintenance notifications, and other communications related to your residency.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out of future messages, or HELP for assistance. You may also contact the community office at 870-233-9798 or marketing@hometownmeadows.com. Opting out of text messages does not relieve you of any obligation under your lease, and Hometown Meadows may continue to send legally required notices by other means.

You agree that Hometown Meadows may communicate with you about your application or residency by email, text (if opted in), phone, mail, or notices posted at your home, as permitted by law and your lease.

06 Maintenance and "Report a Problem" Requests

Requests submitted through the Site are routed to the community office. Submitting a request through the Site does not by itself constitute written notice under your lease or Arkansas law for matters that require formal notice. For emergencies involving fire, gas, flooding, or a threat to life or safety, call 911 first, then call the office at (870) 233-9798.

07 Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Submit an application or payment on behalf of another person without their authorization.
• Attempt to gain unauthorized access to any part of the Site, other users' accounts, or our systems.
• Interfere with the Site's operation, introduce malicious code, or use automated tools to scrape or harvest content or data.
• Post or transmit content that is defamatory, harassing, discriminatory, or infringing.

We may suspend or terminate your access to the Site for any violation.

08 Intellectual Property

The Site and its content — including text, photographs, floor plans, maps, logos, and the Hometown Meadows name and mascot — are owned by Kubera Homes LLC or its licensors and are protected by copyright and trademark law. You may view and print Site content for your personal, non-commercial use in connection with the community. Any other use requires our written permission.

Photographs and floor plans are representative. Actual homes may vary in layout, finish, and features.

09 Fair Housing

Hometown Meadows complies with the federal Fair Housing Act and the Arkansas Fair Housing Act and does not discriminate on the basis of race, color, religion, sex, national origin, familial status, or disability. Housing Choice Vouchers are accepted. If you need a reasonable accommodation to use the Site or the application process, contact the office and we will assist you.

10 Third-Party Services

The Site uses third-party services for payments, screening, mapping, and communications, and may link to external websites. We do not control and are not responsible for those services or sites. Your use of them is at your own risk and subject to their own terms.

11 Disclaimer of Warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Nothing in this Section limits any warranty or obligation owed to you under a signed lease or under Arkansas landlord-tenant law.

12 Limitation of Liability

To the fullest extent permitted by law, Kubera Homes LLC, its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, including lost data or lost profits, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed the greater of the fees you paid through the Site in the twelve months before the claim or one hundred dollars ($100).

This Section applies to the Site only. Your rights and our obligations under a signed lease are governed by that lease and applicable law.

13 Indemnification

You agree to indemnify and hold harmless Kubera Homes LLC and its members, managers, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or any false information you submit.

14 Governing Law and Disputes

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts serving Howard County, Arkansas, and you consent to the jurisdiction of those courts. Disputes arising under a lease are governed by the lease and Arkansas landlord-tenant law.

15 Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site with a new effective date. Continued use of the Site after a change means you accept the revised Terms.

16 General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Hometown Meadows regarding the Site. They do not replace or modify any lease.
